I think people are forgetting the right of assocation. This should apply to web pages because linking is really just associating the file with the site. It really pisses me off to see this bullshit going on in a free community. If shit like this continues, all of the Internet left will be heavily regulated. By who? The US government of course... It would seem to me that innocent party is anyone who hasn't posted the source code or contributed to the developement of DeCSS. Therefore, EACH AND EVERY ONE OF YOU WHO DOWNLOADED THE SOURCE IS AN INNOCENT PARTY, since its not a crime to browse the internet.
I would like to also point out that none of this really means anything. Developement will continue in other countries reguardless of what happens in the U.S. Courtrooms. Just like GnuPG. I do like the whack the mole concept. But the image that comes to my mind is CSS trying to convince the judge to hold back the waters with his bare hands when Hoover Dam just broke. He's not Moses and he probably knows it. But he has to give CSS a fair court hearing, and be objective, even if it doesn't really affect much.
I have to look at the bright side of all this. Even outside the U.S., DeCSS is getting mucho publicity in the Linux community. No project looks sweeter to work on. So it will probably produce some of the most finely honed pieces of software available for Linux. Not many of us don't know about places like, say, this wonderful site not based in the U.S., so its all going to be accessible to us regardless of any ruling that is made. Even if you can't get it from a U.S. mirror, it will still be there. The people who really need to be concerned with this is, say, RedHat, Caldera, SuSe, etc. because not being able to include such nifty tools in thier package could really affect the biz.
The bottom line is CSS is not worried about much else besides thier ability to regionalize. They will sink lots of cash into this, because they anticipated regionalization into thier business plan, and now they can't do it. but again, unless they get Moses on thier side, all they are going to see is a white wall of water coming down on them, because it is too late to stop up the dam.

the underground
the mp3 movement is a revolution. its making people both consumer and corporation alike rethink the entire music industry. trading copyrighted materials is pirating which is illegal. no matter how much people try and delude, er convince themselves otherwise. making mp3 copies of all your cds is perfectly legal. however, the temptation to pirate is great. esp for those college students on the LAN (which has really been the incubator for the mp3 movement).
now for the good stuff. there is and has been a virile mp3 underground that lives on irc. this has been going on since the beginning of mp3s back in early 97. organized groups, private ftps, public bots, new releases, pre-releases (yes virginia, you can find stuff that wont be released for another 2-4 weeks, sometimes several months even). one place you might try hitting up that i havent heard mention of in this thread is mp3.box.sk. the box has a lot of good stuff. but again, i've always believed that people are your best resource. thats why this napster thing has 'exploded' if you will like it has. its enabled winblows users to trade with unimaginable ease.
but when the dust clears and the RIAA has shut down the napster folks, there will still be pirate groups, private ftps, bots, etc. its the kind of stuff that the mainstream doesnt see (uh, wouldnt that be the definition of underground?). and if it makes news and the RIAA decides to go after those folk like the BSA tried against the warez scene (ahahaha.. i just have to laugh at that), then it will only go deeper underground. the mp3 scene is here to stay. just to wet your imagination, there are countless private servers that are all over the 100g size (full albums, 160kbs+). are you hard now?
im not going to defend the actions of those who choose to pirate, but this napster thing is barely the tip of the iceberg. the only thing that makes it unique is that its public. whoop-te-doo. shitty bitrates, unreliability, mislabled songs.. leaves a lot to be desired. -

I really don't think there are any COTS software apps dedicated to CT, (ie. MS LoopHole Exploiter 2000 or some such thing). There are, however, many, many people out there who devote their lives to finding ways around security. Many of them are all to proud to show off their newest exploits or workarounds.
Astalavista and sister sites take great pride in allowing you to do things you shouldn't. However, most of these tricks, scripts, and cracks are relativly harmless compared to a single man placing a pipebomb at the nearest telephone switching station.
There is no such thing as "security" as most people like to think about it. The best you can do is stop the incompetent (they weren't a threat anyway) and slow down the professionals (who you will never be able to stop).
CT can, and probably will be a problem, but I don't think we have reached that critical point yet.
