Yes (s)he can, in the US
The US has a law where a patent can be filed up to one year after being published. This is what happened with LZW; Welch sent it to the journal, it got published, Uni$ys patented it.

Is This More Important Than the Future of Patents?
Wow! I cannot believe that this kind of story is more important to slashdot.org editors and staff than the chance to get an Open Source advocate on the Patent Public Advisory Committee!
The US Patent Office is starting a Public Advisory Committee to "review the policies, goals, performance, budget and user fees of the United States Patent and Trademark Office (USPTO) with respect to patents." Can you imagine what could happen if Tim O'Reilly or Richard Stallman was on that committee?

details are a little different, but it happened almost just like you postulated (except it's with the compression algorithm in the gifs...Unisys has a patent on that).

Unisys Licensing RelationshipWhy did Slashdot choose not to either fight the bogus Unisys LZW patent, or to remove GIF images?
Did andover.net pay Unisys to use GIFs on slashdot.org and its other sites? And, if so, why is a leading open source news site giving direct financial support to software patents?

Precedent against LZW "contributory infringement"?
It looks as though this case could be used in an argument against UNISYS's idea of "contributory infringement" of their LZW-compression patent.
UNISYS wants to hold web-site operators responsible for GIFs that appear on their site (search for "LZW" to see previous discussions here, or visit www.burnallgifs.org).
This case might apply when the only GIFs on a site are those that are passed through by an ad broker, leaving the ad broker and not the site operator responsible for paying the GIF tax, which is the way I think it ought to be. -

This seems almost as bad as Unisys's patent on the LZW comression method. (see BurnAllGifs for more on this). Maybe we could have a "Burn Amazon" day? Destroy our cookies? Request that Amazon delete out credit-card info? Somebody needs to tell these people that patents are supposed to be for fundamental technologies, not mathematical algorithms or minor UI improvements...
