Another option for encrypted email is https://mail.lokmail.net.
They do PGP for in and out email, and SSL between the webserver and the client. You can also have them do a domain for you at USD 30 per year.
Having used them for awhile, the only complaint I have is that they do not have a nice integrated email directory, so I have to manually key in addresses. They do have a directory so that I can put the addresses in the account, and I can cut and paste if I want to go that route.

Poison the dataYou can't stop M$ from collecting your data on their servers - if it against trhe law they'll break the law, simple as that. This is not the first time M$ collects this kind of data - remember M$Office GUIDs, regwiz tricks, etc. Whatever is the reason they need this data is a mystery, but it seems like they are trying to do this repeatedly.
However, you could poison the data, i.e. make a lot of invalid entries - like creating new account on Hotmail each time you need to lookup something on MSDN, etc. As signal-to-noise ratio goes down M$ would end up with huge database, most of data in which is outdated and therefore useles for most Evil Purposes(TM).
As for secure trusted email the best I've seen is Lokmail - they support standart PGP.

is the only webmail service that actually
uses good old fashioned PGP encryption over
an SSL link. I think promoting PGP use
and not a new proprietary encryption system is
a better way to fly. You can get a free
PGP webmail account at lokmail right now.

Hushmail can only send encrypted email to other Hushmail users (and NO Hushmail users are on Macs, because it doesn't WORK on a Mac). I'd much rather use Lokmail which does PGP over SSL. They're two different approaches, and I prefer the interoperability with PGP users
..
Of course, PGP (GnuPG) is the best, but if you can't use it for some reason, I think Lokmail is the next best thing.
Bruce Schneier gave a pretty lukewarm review of Hushmail, by the way... there's no telling where that applet came from. -
PGP Webmail
Lokmail.net has a free webmail service which is PGP enabled. I don't know about y'all, but I like interoperability in my Carnivore busting..
Anyway, since when is Carnivore busting such a big deal? I would suggest to anyone who can't use PGP directly for whatever reason to get a Lokmail account.
