Disclaimer does not always work!When looking at a contract/disclaimer, things are analyzed, fairness, etc. If you buy a software package, it does not work, you still can get a refund.
Law is not black and white. There are such things as unfair enrichment. Look at Vault v. Quaid. Part of the court decision included that it could not be negotiated, etc.
NSI is a monopoly, which should entitled the other party to argue that they must be hold to a higher standard.

This is old!NSI has done this before with many others. I have seen this happen, with them just dropping names that had been registered. Not even dealing with a transfer.
NSI should be hit with a large damage award on GP.
I'm not crazy about name squatters, but I don't really blame greatdomains.com on this one. They requested an available domain, they got it. NSI screwed up by giving them an domain that was already taken.

The CEO threatened to sit on my arms because I was not typing fast enough. My ex-manager at (Mattel/MSI/TLC) monitored my internet usage from home, followed me around the office, complained about taking time for treatment. So forgive me if I lack a sense humor. Maybe it's the pain from the surgery getting to me.

Anti SLAPP!!Last month WCVB-TV, Susan Wornick, et. all won against Metabolife using the Anti Slap statutes. This was in the San Diego Federal Court.
Metabolife sued for slander based on a news piece that Susan had done. This appeared in the Boston Globe.

The damage is what ever you define it as. There is value to your personal information. If there was not, then why would they collect it? Some number can be determined. It is the same type of problem in a slander or libel suit. But in this case, you can disgourge them of the money that they have made in this manner.

There are no bugs...There are no bugs, just unexpected, unplanned, features.
Actually, I have put features into software that I did not tell users about. Some of it is for diagnostic purposes, some is for later work.
Putting in code to send information from or about your machine without authorization is another thing.
This might make an interesting criminal trial.

Which laws?Even just talking about state laws, there are so many consumer protection laws now, which one would apply?
I know in Mass. it's MGL c.93A which requires a certified letter and 30 days. After that, the consumer may be able to obtain 3x damages plus attorney fees. YOur state's milage may vary.
Now, what about international law?
In a situation where a company is located 1000 miles away, is it practical to file a suit over $100 dollars?
One good way to protect yourself is to use a credit card. Most will help with disputes.

We all know they have a disclaimer.
I told him, I should ask for a refund, based on the disclaimer, saying to get a refund if I did not agree with the terms. We all know how quickly M$ has refunded the money for people not running Windows, but the machine came preloaded. When they refuse to do that, we use that against them for the disclaimer of bugs. They can't have it both ways!!

Bias in computer magazineA couple of years ago, I spoke to the author of a compiler review. I had read his review and it said great things about the Watcom compiler, but it ranked three in the score. He told me that when he submitted the review to the magazine, Watcom had the highest score. We both believed that the scores reflect the advertising dollars.

Mattel is the one who filed a libel countersuit against me! Mattel is the one who are trying to shut me up by claiming that I am lying. I am not the only one that they used legal action or the threat of legal action (an example) to squelch people.

There are protection for ISPs in cases like this for websites. It is fair to use company names (even if trademarked) when talking about them. This will come out in the courts in relation to meta tags. The judges and juries will have to be educated on tags and search engines.

How much encryption is enough?NO matter what, the earlier data in the stream is not as secure as the later data, how much value is in it? The later data will always be more secure, think of it in terms of compression. In most forms of compression (except maybe a fixed table huffman or repeat character encoding), the ration will increase as the model is improved (by more data sampling, until your model becomes invalid). In most forms of compression, if you lose earlier data, the later data would be lost. That's why there is ECC (but that expands the amount of data in the stream).
A way to enhance the earlier compression, is to use a randomly generated seed table for the encryption which is sent later in the stream. But, if you lose the later data, you lose the entire stream. But then you will have to use a fixed encryption on that packet, and that packet can always be sniffed.

Why would the DMA be against SPAM?This is like expecting MAMBLA to stop child porn.
They are composed of and funded by companies that make money from SPAM! They are a voluntary organization, if the company does not like their position, the company can leave.
The only way to stop spam is to provide LEGAL penalties for company that spam (on a federal level) and provide for statutory damages, so that they would have to pay without a showing of actual damages. Set it up so, the corporate veil is pierced. Then each time they send it, it will cost them lots of money! Requiring the registration companies to handle the responses for SPAMMER will help

Get slapped.I'm not sure if I would trust it. It may get me slapped by not translating correctly. It may translate, "hello miss, are you hot?" to "?hola chica, tu esta caliente?" instead of "hola seniorita, tu tienes color?"

Users can't use!You can add additional levels of security and require 32 character random passwords that change hourly making the sytem more secure. The problem is the more security you add, the more difficult for a typical user to use the system.
I was just discussing this with an attorney in regards to setting up a website. You can't depend on a typical user using PGP (many can't even spell PGP). He did suggest a form via https, but then it will not be secure, but it will be on the server unencrypted until the process encrypts and emails it.
I suggested a java applet, that will encrypt the data before sending it to the server. Then the server can send it to the lawyer.
There is no absolute security, but you have to balance the ease of access to the security of the data.

Memory image will help.Having the memory image will help. What would help more, is to know how the memory image got there!
We will then know, where it crashed. What is more important, is why it crashed! By the time it crashed, the real cause of the crash could be 10 layers away.
Any more information will help though.

Not just ALT tags!There are also nagivation graphics that cause problems. Try running w/o images for a while and you will realize some of the problems. Besides that, you'll much faster and miss much of the banner advertising.

Teacher should be fired!Outstanding??? How could a teacher give a good grade to something that bad?
I may not be a grammar scholar or a writing teacher, but I do know that this piece had a few grammar problems.
What the Austin radio station have not mentioned is that the teacher asked for a scary story. If this was "i get me want bike from store i so went driving the new one under street to light" then, we never would have heard of how bad of a teacher this student had.

When we go to the airport, we have to show identification, get sniffed, magnetised, and x-ray'd. This is all without being accused or suspected of a crime.
When leaving an airport parking lot last night, the parking lot attendant demanded my VIN (then called the police when I refused), since I had a temporary license plate.
When you go into Best Buy, with a laptop, they demand to inspect your bag. To protect "us" from shoplifters. Even though anything of value is secured anyways.
