The article isn't very telling with regard to the factors contributing to the inconsistant decision with regard to the domain ownership. This is a cop out really:
"The respondent registered the domain name with the intention to link it to a free-speech site," the ruling said.
I think it's sufficient. Actually, though, if you go read the entire decision you'll find that they did dither a whole bunch before deciding that this was pretty much all it took.
What I really liked, though, was the other opinion. There were three judges on the panel, and two of them wrote this long, tortuous analysis of the application of the domain name registration policies, complete with cites of relevant cases and analyses of how they applied. The third judge agreed with their conclusion, but his analysis was much simpler.
He just pointed out that the first requirement of the policy that allows a domain name to be cancelled or transferred was that the name must be confusingly similar to the complainants domain (meaning someone might think that michaelbloombergsucks.com is an official Bloomberg site), and then noted that:
... the "sucks" suffix precludes any reasonable person from believing that the domain name is associated with or authorized by Complainant.It's so nice when you see legal minds following rational paths...

Related sitesThere's already Sucks.com, which is pointed to by gmsucks.com. (They also have intelsucks.com, microsoftsucks.com, and a number of others, all of which point to sucks.com. Nobody seems overly excited about that.
The wierd thing here is that Ford is sueing, not GM. GM may have a case, because something using their trademark is being redirected to a competitor. It's hard to see how Ford can show injury. What's the legal theory?

.sucks.com and .rules.com domainsI mentally went on a step from this and made some interesting(ish) discoveries
The domains sucks.com and rules.com are not being used for this sort of purpose. sucks.com exhibits a "coming soon" sign, and rules.com seems to have been snaffled by a speculator/hosting company.
If I owned these domains I would be selling subdomains, and making lotsa dosh! I shudder to think of the money geeks would pay to get domains like microsoft.sucks.com, or linux.rules.com. People would probably play ~internic rates for subdomains there, IMHO....
Besides, it be much more fun to tease those who only sorta get the tech, but exploiting holes in their knowledge....
