None at all - unless you count the money and time you'll spend defending yourself if they sue.
I have a webpage at http://www.whitis.com/mailwiper.htm about MailWiper, who were selling supposed anti-spam software and advertising by sending spam. They then moved into the spyware business, loading spyware onto machines, and selling SpyWiper, a tool purported to get rid of spyware. They've since been tied to Spamford Wallace, and driven out of business by the FTC who filed charges on them.
They sent me a cease and desist. And one to my upstream, and one to *his* upstream. I took the page offline for a few weeks while I sorted it out, then put it back up.
There is no possible way they could win a lawsuit - but if they filed it, I'd have no choice but to defend. And that takes time and money.
All of this is from a US perspective. I've heard that in Europe, truth is *not* a defense, but I can't say for sure.

He's currently under a TRO to keep him from marketing his "spyware removal tool" which was advertised by spam and spyware, and which appears to do lots of harm but to be no help at all in removing spyware.

His partner in the Spy Wiper business is Rob Martinson. Rob, like Spamford, is also salt of the earth. You can read his history in this article "A Hated Man".

Mailwiper and SpywiperRob Martinson is the owner of Mailwiper - software which claims to get rid of spam in your email box. He advertises it by sending spam. He also owns Spywiper, which is more the subject of this article. I'm surprised that he isn't mentioned in it. He had a lawyer send me, my webhost, and his upstream a "Cease and Desist" letter because I put up a web page when he refused to stop spamming me. The page is still up - I won't meakly comply with scum who don't want the truth told.
Also not mentioned in the article is that another well known spammer, Walt "Picklejar" Rines, is also involved.
My page is at http://www.whitis.com/mailwiper.htm. To the people who believe Spamford when he says "I didn't break the law, I'm just doing something that you want to make a law against" I'd point out several things. First, all spammers claim to be innocent. Rule #1, spammer lie.
Fraud has been illegal for a long time. Businesses can be sued for damages caused by negligence, even if they *aren't* trying to cause harm - and Spywiper appears to be designed to cause harm. This isn't Spamfords first time to find something that he claims isn't illegal and get in trouble for it - he was part of the reason for junk fax laws. He's also lost several lawsuits over spam. I believe that some of them left penalties to be assessed later if he is caught spamming customers of the companies that won those suits. I suspect that if they were to check, they would find Mailwiper spam that puts him deeply in debt.
The "honest citizen" that you are defending isn't honest. He's just a con man. Always has been, always will be.

Technically, free speech is protected in the US - true enough. However, you can still be sued for telling the truth, and if sued, you have to defend yourself (a fairly expensive process) or you *will* lose the case. I've been doing some research in that area recently, after receiving a cease-and-desist letter from a lawyer. I have a webpage which describes how a company named MailWiper (supposedly selling anti-spam software) has been advertising via spam, with links to other sites showing that their sister company (supposedly anti-spyware) has been forcing spyware onto peoples computers and telling them "To get rid of this, you have to buy our anti-spyware software." The spammer apparently doesn't like the free publicity I've given him.
The page is at http://www.whitis.com/mailwiper.htm. Despite the fact that everything I say is true, and many other sites also discuss the companies business practices, if the spammer does sue, I will have to defend. I would certainly expect to win the case - but I'll have to hire a lawyer to do it.

Re:The RIGHT way of using the state to kill spamNow how do we get the government to act? Simple--just believe all of the return email addresses on the spam. If I get 30 messages a day that claim to be from hotmail.com addresses, then I'm going to send them all to hotmail. Either they really are hotmail users (no chance of course, but they'd be kicked off if they were), or someone is illegally misrepresenting themselves, and defrauding hotmail to do it. Hotmail should be getting tens of thousands of reports a day from dutiful citizens, until they start to go after spammers stealing their domain name.
So, when a spammer forges my domain, as happened recently, everyone they spam is supposed to bitch and whine to me? Fuck you. I already have to deal with bounces, and now I'm supposed to deal with your complaints, because it's too darn hard for you to do anything other than hit reply and complain to me - a victim.

Same spammer forged other domains, also.The article doesn't mention it, but the spam advertised the website mypillsrx.com, where they claim to sell various prescription drugs. More likely, they just collect your money or credit card number.

Eddy Marin, a well known spammer with a history that includes convinctions for cocain dealing, money laundering, and who was involved with pornography, seems to be behind the spam.
In the meantime, his pet lawyer, Mark Felstein, ( check out the cute picture) is suing several people who fight against spam for blacklisting "anonymous members" of his newly created EmarketersAmerica organization, and several anti-spam sites all over are being under DoS attacks.
The spammers are winning because the good guys are playing fair and honest while the spammers have no morals are are making up their own rules.

A joe job is the term used when a spammer forges domain names or email addresses as the sender so that after he sends a million spams, the bounces go to someone else. Innocent people have to deal with the bounces, while the spammer hides his tracks.
It's happening to me right now.
This page discusses how mypillsrx.com is forging whitis.com addresses, as well as addresses from several other domains, to send their spam.

I hate to be the one to point it out to you, but the state of California just did.
However kneejerk popular these spam laws are, that doesnt make them right. Please dont bother citing Rowan v. Post office because that case concerned the sending of unsolicited obscene PORN through the mail not all junk mail.
I could argue with you about he scope of Rowan vs Post Office, but I'll leave that for someone else.
I will, however, point out that unsolicited faxes have been illegal for some time. Unsolicited telephone sales have had a number of restrictions for some time, and a national do-not-call list has now been created.
You seem to think that spam is free speech, protected by the first amendment. But courts have consistently ruled otherwise. The fact that spammers try to force their advertising costs, as well as the ads, onto unwilling recipients *does matter* when the law looks at it.
As to your "model spam law":
A "Do Not Email" list would be great for spammers - they would love to get that list of email addressees.
Opting out of every spammers mailing list would take you the rest of your life - and new spammers and new mailing lists would continue to crop up.
I'm not sure if you would consider a forged address to be OK or not. You say that "fake unreplyable email names" should not be allowed. If the spammer forges someone elses address, as is happening to me, is that OK? It's replyable - but the mail goes to someone other than the spammer. It's happening to me, right now. Right now, Eddy Marin, a relatively well known spammer in the US, with a long criminal history, is sending out spam which uses fake addresses at my domain as the sender. (ie, forged in the From line.) I'm implicated, through no fault of my own. He isn't forging my domain on all of his spam, he is also forging other domains. The spams want the recipient to click through to http://69.60.4.240/?p=6062 (the ?p= number changes fairly often, but the IP is a constant.) That ends up resolving at http://www.mypillsrx.com, where they sell various kinds of drugs, writing you a "free prescription" for whatever you buy.
I'm getting the bounces from their crap. So far, I've had no complaints about "whitis.com sending spam", but I know other forged sites that have received those complaints. And the spammer, his upstream, and every place I've tried complaining have been totally non responsive. The spam, and the forgery, continues, even as we hold this discussion.
