Microsoft Fends Off Data Request, FBI Gets Data Another Way

An anonymous reader writes "In a time when the government avows that it cannot carry out justice without issuing secret warrants and National Security Letters to anyone other than the suspect, it is truly noteworthy when news breaks that the FBI, facing push-back from the likes of a company such as Microsoft, finds that it can indeed gather the information it needs for its investigation through a regular search warrant applied directly to its suspect. Such was the case on Thursday. Court documents (PDF) reveal that Microsoft filed a petition against the National Security Letter (NSL) it received involving one of its customers, citing violations to the First Amendment. The FBI later withdrew the NSL and went after their suspect in the old, Constitutionally-sound way. A federal judge ruled last year that the NSLs impinge on free speech' That judgement has been stayed, of course, pending appeal."

    In other words, roping in government information gathering abilities is an exercise in futility. If Google/Microsoft/Apple/IBM/etc. won't directly surrender confidential or sensitive personal information, they can get it another way. In effect, citizens have no right or expectation of privacy from the government.

      Nobody in all of these debates has been arguing that the government shouldn't have access to information to investigate crime, catch terrorists, etc.
      We just want them to be made to follow the rules, especially the Bill of Rights.

      They didn't go directly to Microsoft and successfully get the information without any oversight. They had to get a judge to sign off on it.

      This is the way they're supposed to be getting it. Judges may or may not rubber stamp it, but at least it's gone through a process -- lately they've just been getting information without a warrant or oversight on the basis that they want it.

      If anything, this is (hopefully) the beginning of things swinging back to these agencies being required to show cause and follow the proper procedures, instead of just side-stepping those and getting it on demand.

      Actually, there are some people who have been arguing that, some from the perspective of anti-government entirely, others from a perspective that government shouldn't consider these things crimes, and some who possibly just don't know what they were saying.

      This has NOTHING to do with getting the information.

      The issue is NSL recipient's free speech vs. NSL nondisclosure requirement. Nothing to even do with the target of the NSL, or scope of a warrant. We don't even know how the FBI ended up getting the information they wanted about their suspects, other than through one of X, Y or Z probably in the redacted document.

      Christ, the linked court document even says in very easy to understand text:

      b) Setting aside the NSL as oppressive and unreasonable because the documents requested are more appropriately sought directly from XXXX, or, in the alternative, modifying the Nondisclosure Provisions to allow Microsoft to disclose the NSL to ZZZZ; and YYYY

      I'm half surprised nobody has managed to write NSA instead of FBI on this page yet.

      And some of us believe that we shouldn't be spied upon if we're not committing a crime. If there's not a [i]reason[/i] to look at me, then don't. And no, having a friend in another country (or multiple friends) is not a reason to question my morals or ethics, and it's far from being a crime.

      Unfortunately, once this information is gathered (illegally), it becomes available in perpetuity. If, 10 years from now your particularly powerful boss decides to do a little digging, is he/she going to be concerned that you had an orgy with your roommate and the football team? Is it any of his business?

      You have a child's worldview.

      In the real world, we have both corruption in government, a legal system with very serious problems involving ethical conflicts of interest in the practice of law. We also have many unscrupulous individuals who will use and abuse the government and the legal system for their own sociopathic purposes, and to the harm of society.

      Protecting information from such people is very important, and the existing rules weren't written to do that, so even if they were being followed they aren't necessarily of much help.

      A corrupt government and unethical legal system can very well define "crime" or even "terrorist" in ways that are have nothing to do with reality, but which are convenient to serve various purposes having nothing to do with the long term good of society.

      That was in the era where software was delivered/obtained and installed on the users computer. This is the age of server based subscription applications. They were only allowing back doors into other people's equipment, never MS server total access if they could help it.

      NSA is known to not like sharing it's information. Just because one government agency has it doesn't many that all government agencies have it.

      Which if you start thinking deeply about such things you realize that all organizations are political and many have a tendency to want to keep power in their own hands. Sharing information when you are an information agency is a distribution of power. And you have these sorts of struggles within an agency too. The right hand doesn't necessarily have access to what the left hand has. Even if it legally has the right too. In this case sharing such illegally collected information with the FBI would be illegal as well. No reason to share evidence of your crimes with other organizations.

      Not that they don't ever play nice. But organizations are made up of people and there's all sorts of people in the world.

    The govt will just say that NSLs are only issued to Terrorists and that said Terrorists are not protected by the constitution. It has happened several times under Bush's regime, you would be naive to think that Obama would change that.

    In reading the documents, the NSL surrounded a Microsoft enterprise customer. This could have been around Azure or any other professional service that Microsoft offers to organizations. Since the documents provided don't disclose a who, it could be assumed that the FBI was looking into a company, not an individual. Since everything else around this case is sealed, we'll never know who or what organization was targeted by the NSL which again problematic in a free country.

    I find this other statement hilarious.

    It's obvious that the Customer knows now that they're targeted in an investigation and "lawful" means would imply that the NSL wasn't legal or possibly that the FBI uses "unlawful" means of obtaining information? I guess I just find the wording funny, I mean they could have just said "we obtained a search warrant and served it directly on the suspect."

      Presumably (if "lawful" is correct) they would have had to disclose what the investigation was about to the judge, but I think the implication is that they didn't have to disclose it to the suspect.

    This works for past bad deeds. Where the evidence of a crime already exists and only needs to be collected. It doesn't help with collecting data in anticipation of future wrongdoing.

    This works to deter people or organizations who don't want to get caught after the fact. It doesn't help in the event that organization doesn't care one way or another. Like the people flying planes into buildings. Sure, go ahead and charge them with a crime. They are beyond caring.

    What this comes down to is: In order to live in a society with the sort of freedoms we have beed accustomed to for the past few hundred years, we are going to have to live with 3000 lives more or less lost every decade or so. On the other hand, we could live in neat and orderly society. But I don't want to be caned for chewing gum in public. I'll put up with the occasional sticky wad under the bus seat in exchange for my freedom.

      I think I'd go along with you and accept those risks in exchange for our freedoms and Constitutional tradition. Since that death toll is on par with the number of Native American/Alaskan/Eskimo/Inuit women who die in the same timeframe from injuries involving motorized land transportation, it's clearly a number that we can deal with.

      Now if anyone says: "well, try telling that to the families of the victims of terrorism" I would have to counter that we don't feel compelled to put on sackcloth and ashes over all the far more numerous but less dramatic deaths that occur all around us all the time. Something like 3000 Americans die every year of peptic ulcers for God's sake. Their families are every bit as griefstricken as if their Mom/Dad/Wife/Husband/Child had been killed by a bombing or hijacking. I guess they had the decency to die one at a time in homes and hospitals so as not to upset everyone else.

      We trash important parts of our Constitution and spend untold lives and treasure for 3000 victims of terrorism. If we genuinely cared about people, we'd be outraged by the fact that tens of thousands die each year in the US from inadequate health care. But try to get universal medical coverage and watch the firestorm of outrage. Increase penalties for distracted driving? No way, because freedom to text and drive! But Trash the Bill of Rights, not so much.

      Am I suggesting we do nothing about the threat of terrorism? No, I'm saying that the countermeasures should be proportional to the actual risk, not to the headline value.

      Umm, we don't actually WANT the government "collecting data in anticipation of future wrongdoing".

      No, it's called probable cause. They don't need to have evidence yet, they only need to have probable cause that such evidence exists. If they can't show an actual reason why such evidence probably exists, why should they get to invade your privacy or take your stuff? That's what some big chunks of the constitution are all about.

      What I'm saying is that collecting intelligence pointing to a crime that might be commited in the future is stepping over the bounds of how this country was originally envisioned. The occasional conspiracy may develop into a full blown crime or act of terrorism. But I'd rather lose 3000 people once every dozen years than give up the principles upon which this country was founded.

      Conspiracy is a crime, even if the crime you're conspiring about hasn't been committed yet. Therefore, if there is probable cause of conspiracy, then they can get a warrant to gather actual evidence. Thoughtcrime is not a crime, but once you start planning carrying it out with other people it is. I think we both agree that probable cause to invade our privacy or take our stuff is a legal requirement, we're just debating the one little point of thoughtcrime vs conspiracy vs carrying out the act.

      But I'd rather lose 3000 people once every dozen years than give up the principles upon which this country was founded.

      And which hundreds of thousands have given their lives to protect.

    Let me guess - you don't get any of the attention you crave elsewhere, right? You can be as annoying and self-centered as you like, and never fear that you will be called to account for your excesses. It's like having the internet defending "Mommy's little boy" without the humiliation of Mommy actually having to save her little darling.

    It's like a wonderland for you, isn't it? You can say anything anywhere, no matter how offtopic or unwelcome without fear of reprisal. It must've been hard for you - Daddy didn't care how smart or sensitive you were, he was still disgusted at having a gutless little worm for a son. Did he leave your Mommy over this, or did he just abuse you?

    Now, you seem to feel empowered. You can actively troll, insult, and make a general nuisance of yourself without fear of reprisal. It must really hurt to know that even here on the internet, even without direct contact, you're quivering core of fear is plainly visible for all to see. It must've really hurt to be banned from all of these arenas, to discover that you're not absolutely immune to being called to account. It must hurt even worse to discover that there are no family or friends even here on the internet. You yell your same message "pity me, I've been wronged" without even varying the words.     So, once more - what does anything you've posted here have to do with the current thread under discussion? Or were you just verifying my earlier post on another thread. You will remember, I predicted exactly this behavior. You'll no doubt respond with something along the lines of "two wrongs do make a right", but really - where did the post stalking begin? How many others have you done this to? Thank you for verifying the accuracy of my posts in this specific regard - that you simply lack the emotional and intellectual maturity to do anything more than rant and moan, attempting to hurt all of those mean people you think have done you harm (note that the above mentioned errors on my part resulted directly from your post-stalking behavior). I won't say you brought it on yourself; as I mentioned, I made a mistake. I suppose you don't make any mistakes, eh? Your post-stalking and blogpost spamming are all perfectly okay, because you're right? Let me know when you'll own up for your mistakes, but I'm guessing never. You're a child.     In short - don't be too hard on APK. He can't help it - he's damaged goods.
