This is a good point. I think the question before the main discussion is, "Are carriers exempt from liability if they agree to allow any and all traffic through their media without any monitoring or intervention?"
It does seem to be black and white. Two sides of the dimensionless line. Either the carrier is responsible for all material or no material existing on its lines.
