Well, isn't that the reality of the situation? The law serves as a punishment more than a deterrent. That is how it has always been.
It is clear Microsoft is not aiming for the regular, competitive RTS demographic. No Serious RTS fan is going to pick this up for the reviewers praise of the low APM(Actions Per Minute). I'll stick with C&C3 and Starcraft for now, until Starcraft II is released.:)
I have thought about a world of starcraft also, I am a massive fan of blizzards work but after playing WoW for over 3 months I can't help but think it would just suck.
