I don't want to take sides in this matter... I wouldn't store anything important on an account like this, but also I wouldn't treat someone so rudely and irresponsibly either.
However.... who's going to tell the US Government that Lycos is "permanently deleting information" that is/was on the Internet. Aren't they supposed to keep all of this in case the US Government want to pretend that it justifies the future invasion of Iran or something? I'm sure that one of George Dubya's (The Digital License to do whatever the hell I want with electronic stuff Act?) laws must relate to destruction of this kind of stuff.
