Yes, the government has a strong case. Judge Jackson has ruled Microsoft a monopoly. Judge Jackson may impose big penalties against Microsoft. The truth is that none of the remedies ordered by Jackson will be implemented any time soon.
By not settling, Microsoft can tie this whole thing up in appeals for decades. In the mean time, they can continue their monopolistic practices.
I hate to follow-up my own post. I believe that I found that the US Supreme Court affirmed the case I cited in my prior post by refusing to hear an appeal of the case. See: 111 S.Ct. 1683 IANAL.
May I quote the Constitution of the United States, Article I, Section 9, Paragraph 5:
"No tax or duty shall be laid on articles exported from any state. No preference shall be given by any regulation of commerce or revenue to the ports of one state over those of another: nor shall vessels bound to, or from, one state, be obliged to enter, clear, or pay duties in another."
Litigation in support of said provision of the US Constitution was executed and ajudicated by the US District Court of the Eastern District of California on July 8, 1991. See: CIVS-88-1067 MLS.
In his ruling, the Honorable Milton L. Schwartz, said that not only was California's attempt to collect sales tax on interstate commerce was unenforcable, but California's attempt to collect the so-called "use tax", in an attempt to circumvent the express intent of the United States Constitution, was also unenforcable.
May I suggest to various legislative bodies and taxing authorities that they go fuck themselves until such time that they can amend the Constitution.
The Direct Marketing Association (DMA) is busy right now trying to buy as many congresscritters as possible to make spamming legal. You think the problem is bad now? Wait until the legislature makes it legal to do it, then see if email is usable at all.
Spamming should be in the same category as junk fax. The law (47 USC 227) says that you can sue (small claims court is good) someone who sends you an unsolicited junk fax.
Frankly, I'm inclined to jail the spammers. A suitable penalty would be 1 hour per spam message sent. Second offenders get 5 years, no parole. Third offenders get life without parole.

In a subsistence farming economy, everybody has as many children as possible. It is a way to ensure labor and one's own "social security" in old age. But wait!... Subsistence farming is going the way of the buffalo, if you'll pardon the expression. The most populous nations are becoming capitalist economies. This places a large portion of the world's existing population in other-than subsistence farming economies. Now, here's the rub:
The state, in most industrialized nations, provides substantial benefits, under the guise of a "social safety net". This includes transfer payments from working people to retired people at some age. Most industrialized nations lavish free medical care on all. Even in the USofA, if you are old or very young, you get free, unlimited health care.... Frankly, it is very hard to starve to death here. So, the need for many children, to accont for attrition and to provide for social security is not an issue.
In an industrial economy, it is expensive to just be alive. One must, for all practical purposes, have housing, food (bought), clothing, trinkets, and pay taxes. Most folks in these economies what for their children more than they had themselves. This means education; education is expensive, regardless of "free" state provided schools. In the USofA, bringing an infant to majority and through college is an expensive proposition.
Worse, in most industrialized nations, the more you make, the higher the tax burden, both in life and at your death. Hence, the economic decision is to have fewer children, provide for their education so that that they can achieve their own wealth, and leave as little as possible for the tax man, a place where there is no return on investment.
Some learned person (?) observed that the longer it takes to raise offspring, the fewer offspring one is likely to have, regardless of species. It's economics.... Somebody wanna look this up?
Anyway, this appears to be a no-brainer. But, leave it to the UN to not be able to figure it out.
