The Fourth amendment is triggered by federal government action (extended to state action under the 14th Amendment), and does *not* require anyone to "act as an agent of law enforcement." While Fourth amendment cases generally concern law enforcment, there are many others that revolve around other state actions (administrative searches by quasi-governmental agencies, school locker searches by school personnel, etc.). Otherwise, it's an interesting post.
