This sound very much like the functionality of the Recycle Bin in windows. Sometimes I wish I had a recycle bin as well. (I have a nag for typeing rm when I mean mv). But I agree with xenocide2 that this is something for user space. It certainly is not trivial to implement if you want a secure multi-user environment. But for single-user developer-systems a aliased/hacked rm and a deamon could be of great help when you accidentally rm two files instead of replacing one with the other ;)
