What? If trademarks are a restriction of freedom, then me using Keir's name to endorse my own ideas sounds like exactly the type of freedom he's arguing for. So what if it breeds confusion and implies an endorsement that doesn't actually exist?
The other day I was thinking the same thing about radio. "They can listen to our songs for free!?!" Of course the way the RIAA is talking now, radio isn't getting a pass for much longer.
Let's even imagine that spam filters were 99.99% accurate, what would be the benefit of not spamming anymore? It costs them nothing, so if they send out millions of spams per day and only get a few bites, they're still making a profit.
There's no incentive to stop spamming unless it becomes arduous to do so. Nether technology nor litigation are close enough to make that happen.
I think this is a good idea, and if Chu can make it happen (again, colour me cynical)...
