If you go to a convenience store, and the cashier gives you too much change, you are under NO circumstances obligated to return the extra change. However, if the clerk short changes you, he or she IS obligated to fix the error.
So if I go to an ATM and it gives me too much money, unless I take advantage of the situation, the same rules apply. (Unless, of course, when you opened your account, the bank probably made you sign a paper that states that if they make a mistake, it is your duty to fix it)
At my bank, there is a 24-hour hold on all ATM deposits, in order to prevent fraud. So if I put money in an ATM, I can't take it out until 7AM the next business day.
