    I don't care if advertisers put ads in movies/shows/etc, but it shouldn't be accepted by the artist/producer when it affects the quality of the message. The same way you listen to an MP3 and you don't want the song to stop mid chorus with "... brought to you by Coca-Cola"... I don't want product placements to ruin tv shows or movies. It doesn't bother me if someone is wearing a Pepsi t-shirt or eating lunch at McDonald's. I'm sure we all have shirts with product logo's on them. It would only be a negative if it was like EDtv or The Truman Show. Their ad placement was terribly obivous. (probably on purpose, but you get the point.)

    Good point. The questions to ask then, who controls TiVO? The government or corporations. As long as the power isn't centralized, then all is not lost. Additionally, would it be possible to watch TV without TiVo?

    Personally, I am waiting to buy a TiVO until they can allow me to record MTV programs without the censorship blur. When they can do that, I'll pull out my credit card.

    I don't know if it is or not, but thats a damn good explanation for what could be behind it. Question: what is the drug? I'm sure we've all heard about how Berkeley created LSD and Unix, so what does Redmond create in conjunction with Windows?

    Seriously though, I think that this is a good idea. They may never finish, (although I don't know if MS has any way to stop them) but hopefully they can get organized and produce some useful code, even if it is only picked up by another Open Source project.

    Indeed he should. He could claim damages resulting from the injunction. Although that guy with the example of jam and nukes may have a point.

    Hmmm. Perhaps a new tactic is needed. I think friends of Napster/Scour/etc should find some starving new artists that are using these services to spread their music. Then, if/when they are shut down, the artists can claim harm was done to them by the RIAA et all. I'm not a lawyer, but it sounds to me like they could make a decent case-- that by shutting down all music distribution, they were hurting people using it for honest work. The RIAA definitely has deep pockets for a potential plaintiff.

    How is this a corporate republic? This wasn't in the US, it was a Brazilian judge.

    I hope to take this before a US court. I'm not a lawyer but I can't imagine the First Amendment would be allowed to be trammeled this way by a real judge. But who knows? I'm not exactly feeling lucky. Keep the faith.

    I think this just demonstrates why several international treaties should be recycled for use as French Fry containers at the Paris McDonald's. Anybody else notice this:

    At other times Bianchi borders on bazaar. When he rationalizes Complainant's rights to protection despite the fact that they don't even have a Trademark for "CORINTHIANS" (in Brazil or anywhere else), Bianchi says this about their nearest T.M., "CORINTHIAO": "CORINTHIAO in Portuguese is pronounced as Corinthian in English.

    So:

    They don't have a trademark.

    A domain registrar has to worry about foreign language pronounciations. Maybe we should see if a different country has a word for Coca Cola or Nike and then start a soccer club... so we can use the businesses' dot com name.
