I think that it would be treated similarly to the concept of innocent instrumentality: in criminal law, if you cause an innocent actor to commit a crime, you are still punished; like pushing someone into another person.
So i think that using a cat would be like using a stick to the extent that you intend the result.
If you really didnt intend it, then I dont think there has been a meeting of the minds, and no contract would be formed.
