I'm tired of people wanting us to apologize or feel guilty for talent, knowledge, and ableness! There is no guilt in being competent, nor is there guilt in reeping the benefits of your own competence.
I have had similar problems with 3D games, but in my experience, I haven't noticed a specific problem with DirectX. Asheron's Call, admittedly a Windows-only game, is based on DirectX, and I can handle it for embarassingly long hours. On the other hand, I can look at a Quake screen for about 20 seconds before I'm dizzy and nauseous. Does anyone know, is there maybe a different refresh rate these use? This article Preventing Motion Sickness says that motion sickness is caused by your brain getting signals that don't coincide - your body says you're not moving, your eyes are sending signals of a static car, and your inner ear is saying, whoa we're doing 60mph... So, is our brain actually taking the visual input of certain games and translating them as us moving while our inner ear is reporting that we're at rest?
If you are sincerely opposed to Bank of America's attempted action against the Dialectizer, review your personal accounts and your credit cards and switch banks. The following is a list of cards that Bank of America distributes: BoA Credit Cards Check your wallets and see if the logo is on your credit card. Apply for a new credit card, do a transfer balance, and cut up the BoA credit card. Money talks. Remove your money from the bank and let them know why you did it. Perhaps suggest a formal apology to the author of the Dialectizer...

There is already a consulting group that offers the services of searching prior art. http://www.bustpatents.com/ Why don't we make an effort to gather a list of Obvious Underlying Technologies and provide examples to this company? The hardest task we face is determing *what* we need to protect, since we are continually astonished by these applications for patents. So, someone volunteer to compile such a list and let's work with these folks.
