I have seen mention of the physics, the construction, the economics, and someone mentioned social issues. These seem to be the ones always discussed. How about the meteorological effects this will have? How about the ecological effects?
In reply to your comment about Microsoft having a decent solution in MS-SQL. Are you aware of where MS-SQL came from? It was originally the old Sybase code. With 6.5 and 7.0 Microsoft has moved away from the original codebase some but it is still at it's heart the Sybase code.
Let's see most fabs run VMS clusters for their production lines (including Intel). Hmm, last I knew the fabs were still running. I wouldn't call that dead.
SMP is running on alpha. Check out the various dists lists. Or head over to http://www.alphalinux.org a site for linux running on alpha's. It has links to alpha docs, dists, lists, patches and etc. More and more dists are supporting alpha. Might be they are trying to get their dists 64bit ready.
IIRC there is another part about trade secrets which in essence I take to mean that you do not have to use any more measures than the original company took. In this instance since they are not using a secure server, it is about the same as taking a hardcopy of it and leaving it on a park bench somewhere.
How about we write up the business process (method) on filing patents. If we make it long enough and technical maybe it would be approved. Then no could file a patent without our approval.

Actually the Apple suit fizzled after information surfaced that Xerox could file the same claim against them.
