I don't get it either, and if the fair use defense wasn't just a (now discredited) holding action, I really don't get it.
The polarizing thing, though, isn't so much the legality of the outcome, but the amazing mismatch between crime and punishment. But hey, we pot smokers have been dealing with that for decades.
