But that is the catch: If this guy was selling just the chips, with nothing programmed on them, then he would have a legitimate defense. If he was selling them programmed with a hax0red BIOS image, it most likely contained Microsoft copyrighted code, which IS a copyright violation. How that falls under the auspices of the DMCA I don't know.
That said, if there was a legitimate BIOS image, mod chips probably would fall under the interoperability clause of the DMCA. IANAL, but you could at least defend it that way, with all the homebrew software out there.
I didn't say it was OK just because it's digital. I said that among a small group of friends, how is swapping mp3s any different from swapping CDs? Granted, I have some semblence of ethics and I'm a music snob, so if I like a CD I'll buy it, to support the artist and get a superior quality recording.

Case in point, a lot of municipalities still use chlorine gas for water purification, which makes it a big target for terrorist attacks. There are several water treatment plants in my neighborhood, though I happen to know that our local water management district has gone to liquid chlorine after 9/11.

Uh, no, just that LCDs are a completely different tech from CRTs. Every pixel has a transistor driving it, and if that transistor dies, or stays on, you have a dead pixel. This contrasts with CRTs, which have an electron gun that scans the monitor. Some monitors have a grill that said beam passes through, thus if a hole in the grill gets clogged that pixel is dead.
The "true test" isnt tolerating kiddie porn per se, it is tolerating speech you disagree with. There is a quote, often misattributed to Voltaire, "I disapprove of what you say, but I will defend to the death your right to say it." I doubt I, or anyone else, would put their life on the line for a kiddie pornographer, but I truly believe it is a symptom of a greater problem, like drug addiction.
So don't run a node, like you said. Frankly, I acknowledge that kiddie porn exists, and I agree that it is awful, but I have to imagine that it gets exaggerated by the popular media just like the few child abductions related to the internet have.
