  1. VERY IMPORTANT...DO NOT CANCEL YOUR ORDER... on Is Netpliance Slamming Customers? · · Score: 1

This is very important. If you get a call or letter that Netpliance has canceled your order, whether it is a direct sale or through a retailer like Circuit City or CompUSA, DO NOT cancel your order. DO NOT accept the new terms.

I have a couple on order at Circuit City and one at CompUSA and have not yet been canceled. We all have enforceable contracts. Actually very strong contracts. "Contracts for Sale" are regulated by the U.C.C. (Unified Commercial Codes) Statutes.

If this happens you need to contact your State Attorney General's Office. Do a web search and you should find an e-mail address, fax number, phone number or street address. Write to them and include the following:

"I would like to file a complain.."

(Almost every Attorney General's office will have to open a case file for a complaint like this.)

    Include:

    1. Your name

    2. When you purchased, ordered, or left a deposit and the amount

    3. How long you have been waiting

    4. Explain how you relied on the price and terms you were quoted and agreed to at the time. (i.e. at Circuit City, I was told I was guaranteed the $99 price even if it goes back to $299)

    5. Explain how you were contacted and how they tried to cancel your order, or get you to cancel (I believe Netpliance's attorneys want to entice the buyer to cancel to protect themselves) and have you agree to much less favorable terms for you for the same item (very important)

    6. Detail any expenses you made in anticipation of receiving your order (i.e. cables, hard drives, ethernet etc. and the itemized cost) (This is defined as damages under U.C.C.)

    7. Ask them to look into this matter because you believe, Netpliance, Circuit City etc. are take advantage of customers to switch them to a potentially much more expensive contract. (i.e. your $99 I-opener, no contract, cancel at any time could very well cost you $99 + $499 + service charges)

Please, I know most people don't like to go through the trouble to write a letter. But even a brief letter detailing your experiences above will put much heat under Netpliance to comply with the order contracts they undertook.

Here is some background to get you started if you ordered directly from Netpliance:

"Our consumer complaint form is now available on your computer through this website. "

    e-mail: consumerprotection@oag.state.tx.us

    Office of the Attorney General
    Consumer Protection Division
    PO Box 12548
    Austin, TX 78711-2548

"2. We will send a copy of your complaint to the business. "
"3. Your complaint and documents are public information. "

    Here is the online form:

    http://www.oag.state.tx.us/consumer/complaintfor m.htm

Enough complaints and Netpliance will be getting extra mail deliveries from the State's Attorney General.

You can easily find the same information for your state.

Please do this. This can work for us.

    Sincerely,

    Mac Legrandi

  2. Using the modem with other ISPs? on Flat Panel Linux Box for $99? · · Score: 1

Hello! I'm not clear from reading the posts, if after installing a new OS if you will be able to log into your regular ISP (earthlink, etc.) via the built-in modem? I thought there was some discussion that the modem is not standard and would not work? Is this correct? Is the modem still a mystery? I have one on order at CC. and today I got my Mother to order 2 more. I better be able to get this hack to work or I'm in deep water:-) Thanks Jerry
