Why not just use real applications for benchmarks? Koffice permformance could be used to test office apps, Gimp/Povray for graphics, a GPL game for 3d perfomance etc. Since all of these are free anyway, why not use real applications for benchmarks?
Most other countries aren't nearly as bad as the US with the DMCA. Just make sure that it is not developed there.
