  1. Re:Umm their main premise(as you said) is right? on Judge Rakoff Explains MP3.com Ruling · · Score: 1

The hole in your argument is the "should." I agree with you that you "should" be able to. Fact of the matter is that you aren't listening to "your" music though.

1)my.mp3.com making a copy of a cd they purchased and then letting you listen to it is not the same as you making a copy of a cd you purchased and listening to it.

2)No proof of ownership was ever required. Proof of posession of the CD was required. This does not distinguish between your cd and your buddy Joe's. Joe could lend you his cd for the purpose of registering with mp3.com, and then you can get at music you have no right to.

3)You can make as many copies of your music as you want for your own personal use, but, here's the kicker, legally you can't use more then one of them at once.

4)The mp3 you rip and the one mp3.com rips from 2 seperate cd's will not be the same bit for bit even if the original cd's were "exact duplicates" of each other. The digital audio stream goes through the D/A converter on your sound card or CD-RM before anyhting unless you have a digital out on your CD-ROM. Also, different programs will encode slightly differently.

5)IANAL, but I am one in training. While you may not like the restrictions the law places on you, it is still the law. It may not be pretty, but it is the easiest way to protect the rights of the musicians. Note I did not say Pocketbooks.

If it was not your intention to troll then I too am sorry for two reasons. One, I went after you unfairly if you really didn't mean to troll. Two, you actually believe everything you said.

While I can agree with you in some situations, there actualy are some highly intelligent people born in to the situations you describe who have no chance of getting away from them. These people also do not always bring thier situations on themselves. The fact that it hasn't rained in some areas of the world for years is not the fault of these people, nor is the fact that they can't leave. For you to suggest that the smart ones should eat the other weak people only highlights your ignorance on the topic. People who are malnourished and have no muscle mass like the ones you see, sitting around doing nothing, won't provide nutrition to someone else. In fact it would likely cost the person eating the other more energy to digest the other person then any energy they would gain from the nutrients in that person.

That is my take IIRC from what I have read. If I am wrong someone else please enlighten me.

So if you troll and no one feeds the troll, is it your fault if you starve?

I think it is based on your argument, because you obviously didn't troll well enough

I don't know about you, but I usually pick up one or two newspapers in the morning so that I can figure out what I want to look in to later in the day. Paper serves the point of letting me browse through the news without having to stare at the damn monitor. In this case a link might help, but it is not highly likely that it would help me as I usually don't visit the site of whatever newspaper I have been reading. I usually visit more specialized news / discussion sites, like IntellectualCapital.com.

Then again, being a Political Science / Economics major gives me a lot more reason to be doing this then the average Joe.

Most radio stations do not play songs of of cd's. The station I work for does (KTRU, 91.7 Houston, TX), and yes if you call us we will play any song off of the cd so long as we have the cd in the station (and yes, this is an "educational" station so we play a lot of offbeat music rather then mainstream). Most radio stations put the single or singles on to something caled a cassette that looks nothing like a cassette tape, looking more like an 8 track then anything else.

Then again most people calling radio stations don't want to hear anything but the single anyway.

    Not well said

No longer is music made for music's sake. (I realise that this is a naive view, but bear with me here, I'm a makin' a point.) It is made with the singular purpose of selling as many possible records within a very short amount of time.

As a DJ at a college radio station, KTRU I have to strongly disagree with your statement that music is no longer made for music's sake. If you stick to the realm of commercial radio stations I might agree with you, but even then have a hard time agreeing. There are many mainstream bands out there who have "made it" and could care less. They are making music because it is what they want to do. Many artists may dream of "making it," but most of them don't and continue to publish and perform music reguardless.

Now as you extend in to other realms of music outside the world of commercial radio, word music, scordatura, avant-garde jazz, and many of the other things I feature on my shift you will find scores of artists who perform for the sake of music. I am good friends with many of the members of bands that I play and can tell you that their genuine interest is in expressig themselves through their music.

Don't extend the views of a small portion of the music industry to the industry as a whole. There are easily 1000 times more performers who perform for the love of music then performers who do it for the money.

Oh, and if you want to follow the above link to the radio station web site you can listen to my shift Tuesday morning from 7 - 9 am. We broadcast over Real Audio in addition to the airwaves. I give out the station number over the air and would be more then happy to continue this converstaion from there.

Only that the X-Box has the backing of the company with the highest valuation in the US stock market, and with billions of cash at the bank

Actually if you had been paying any attention to the stockmarket you would have noticed that Microsoft lost that position to Cisco Systems a week or two ago. It no longer is the King. Not sure what the story looks like after this last weekend, but I'm pretty sure Cisco took less of a beating then M$ did.
