that doesn't change the process of breaking and entering which refers to the crossing of the boundary between the public area and private area. this is why such protections also apply to the homeless.
where the trick lies I think is whether or not AT&T had a no unauthorized access or use permitted warning posted with regards to the service hosting the script used at least in a legal sense. this would be analogous to a no trespassing sign.
