As this document makes clear, it doesn't matter if Kaplan is guilty of a conflict of interest - what matters is that it appears he is guilty of conflict of interest. The law is clear - he must recuse himeself, because the integrity of the court is what is at stake, not any actual occurance of impropriety. The appearance of impartiality in the court system is always paramount to a judge's right to hear a particular case.

Kaplan is hell-bent on becoming part of history - he wants his name on this case.
Kaplan is clearly going to rule in favor of the Plaintiffs. Even if Kaplan's bias becomes cause for successful appeal, it just means we are back at square one, only poorer.
