    Yeah but they also led to a huge home-based industry for current and old movies. Just to pick a random studio: MGM made a bundle off sales of VHS tapes of its long-forgotten, rarely-seen 1930s,40s,50s titles. If Hollywood had succeeeded in outlawing VCRs, they'd all be a lot poorer.

    Asking a website (example: hulu) to record a show for you is no different than asking your VCR or DVR to record a show for you. In fact it's probably better (for ABC, NBC, etc) because you can't fast-forward through the commercials.

    What if you added whitespace to the top of each photo, emblazed with the logo "Copyright Tom Smith. Use of this image without payment is denied."

    Then if you see your photo online, you know they DELIBERATELY removed the whitespace, thus making them provably guilty of copyright infringement. (They read the notice but deliberately ignored it.)

    You keep repeating that pixelpusher, but you're still wrong. The DMCA *is* the polite method of contacting the other person, and letting them respond to the request (usually with: No it doesn't infringe). Skipping direct to a lawsuit would be the Dbag move.

    No it isn't. DMCA *is* the polite method of contacting the other people. All they need to do is respond "no it doesn't infringe" and the material is restored again, per the law. (It is then the responsibility of the owner to file a lawsuit.)

    And once again, I have to change my previous comment. Here's what this woman emailed privately and posted publicly about the photographer:

    Private - "Now that the issue is resolved and you have your precious image back, do not ever bother me again. You cost me thousands in billable time and I could sue you. You are fortunate it came back up because as usual, an emergency call came in from a very disabled client needing help and it is substantial as to time/effort/predicted fees. Had you not done the right thing, you would have hurt a lot of people, but most pathethically, a MR girl with the mind of a 4 year old who needs my help. Do not harass or stalk me on Twitter or FB or otherwise. I am done and you better be. Donâ(TM)t make me vomit, your lawyer."

    PUBLIC: "Jay Lee Blows It
    I do not believe this many coincidences could come together and be legit. So many things dont add up or sound the alarms, I just canâ(TM)t bring myself to buy the innocent victim role Jay Lee vomits everywhere. Jay Leeâ(TM)s skittish inconsistency, sincere, desperate, apologetic (clearly understanding nothing was knowingly done to him, after he saw all of the wreckage his wrecklessness caused), terror (induced by reading my letter? Realizing he had made a big mistake), inexplicable stalking, bait & switch images on Flickr, removing âoehot potatoâ image and refusing to sell at opportune time, with my letter thrashing him, sent the fear of God through him.

    People are human. If I discovered all 14 of my sites were taken down, while I'm trying to raise money for Special needs, I'd probably respond in a similar angry fashion. I remember how angry I became when Youtube yanked my video offline..... and besides she apologized to the photographer for her outburst. She also commented:

    "The fair use doctrine permits nonprofits more leeway than for profit businesses." - That's not true but it's understandable if she believes it is and thought no harm was done.

    I take back my previous comment, after I saw the owner is a disabled person trying to help other disabled persons. It is better to remove the DMCA and work things out perston-to-person. THEN after the campaign and special needs olympics is over, if the woman is still being difficult, file a new DMCA. "Her websites included a blog which seems to be on a crusade to get someone named Louis Guthrie elected as Harris County Sheriff while taking pot shots at incumbent Adrian Garcia.

    "To make matters even more interesting, Candice Shwaggerâ(TM)s list of Web sites also include some dedicated to promoting and supporting special needs children. A fact I was unaware of when I filed my complaint, but a fact that would come back to bite me later. And, as it turned out, all of these sites are linked together as far as GoDaddy is concerned which resulted in all 14 of them going down after I filed my complaint.

    "Of course, I had no idea. I have been sending DMCA take-down notices on so many sites it was becoming an cookie cutter assembly line process and I was not paying all that close attention. But an email message showed up in my inbox that made me pay attention. It was a notification that someone had commented on the photo in my Flickr account. The comment was from Candice Shwagger:

The infringing person would likely never follow through, or if he did, lose the case and a lot of money. ----- Just like that Oregon Newspaper editor who tried to steal an article from an online reporter. He too threatened to sue but backed down (and paid $500 to the reporter), because he knew he was guilty-guilty-guilty. Downloading something for personal enjoyment is one thing; earning wealth off the back of a worker's labor w/o paying them is entirely different (and evil).

    Los Angeles is the class of ~60 boats (similar to the Constitution class designation in Star Trek). That class is the largest in the world, except for the USSR's Foxtrot (diesel). The "USS Miami" is the name of the actual boat. It's base is located somewhere along the Maine coastline.

    The government has been spending 1/2 to 1 trillion (per year) more than it takes in..... and it has been doing that for a decade. The national+state debt is nearing 20 trillion, which is almost $200,000 owed per American home.

    If you think this can continue without making cuts to government departments, then YOU are the one who is crazy not Paul. We are headed for a EU-style collapse caused by our debt (just sit back and watch that continent... it's our future).

    Pay attention to the still-ongoing race. It's pretty clear Paul will have more delegates than either Santorum or Gingrich managed to win (230), meaning he will be in second place out of the 10+ candidates that originally started a year ago.

    I'm estimating he'll have 1/3rd of the total, or about 700. Not bad for someone who is "unelectable" and "has no chance". These lousy reporters should quit their job, because they're no good at it. They are not there to tell people, "Ignore this candidate. He can't win." They aren't there to try to fix the election; they are there to report the events and let the viewers decide.

    Consumer protection laws say you ARE entitled to not be ripped-off by shysters selling exrement, and said laws side with the customer on virtually every case. Item not delivered? Refund. Item described as new but actually used? Refund. M&Ms didn't taste right and customer returned them? Refund.

    And when I saw Transformers 2, it certainly fit the bill of excrement. The first was good but the second was mind-numbingly dull. Which is why I download before I buy, rather than be screwed out of my money by drek. (And if it's good, then I'll hand over the cash for the Bluray.)

    Not quite the same thing since I get charged (per GB) for the things downloaded. I have a right to turn-off images or flash in order to limit my cost, just the same as I have a right to block people form spamming my fax machine or cellphone (which also costs me & is in fact, illegal).

    TIVO was sued a few years ago for having a commercial skip. They lost. The judge said that commercials are the same as payment for the television shows, and skipping over them was the same as not paying, therefore he forced Tivo to remove the skip feature. I expect the same outcome for Dish.

    The simple answer is that Microsoft has more copyrighted things out in the wild..... Windows of course, but also their various office products, and also games for the Xbox. - Google has less to protect and less infringement to deal with.

    I would have thought the top requester would be the government itself. They are #2 on youtube, demanding that videos be taken down.

    No. They are splitting the frequencies, which is a pretty good idea: "Most of the subsequent telescope dishes and mid-frequency aperture arrays will be built in Southern Africa, while the low-frequency aperture array antennas will be positioned in Australia." - One kilometer of MF and one kilometer of LF reception.
