We're assuming they wouldn't do this to someone they sold boxes or keys to directly if they dared to sell for even a dollar less than MSRP. "Going out of business and unloading inventory? You're making our product look like shit doing that! All keys sold to you in the last 6 months invalidated!" "Clearance sale??? Keys go POOF!"

"Given any reasonable construction of the words in his postings, those statements do not constitute a 'true threat,' and they are therefore protected speech under the First Amendment," the majority wrote in a 2-1 decision.

So no, Congress cannot simply write a new law to get around that in the 9th Circuit (~20% of the population) or any Circuit that is likely to rule the same way. The observation that they didn't even charge him under a law that criminalized what he said (and if it did, it would be unconstitutional) was essentially just icing on the cake.

They didn't discontinue the iPhone 3G until June 7, 2010. Inventories don't often magically evaporate either so who knows when the iPhone 3G was no longer for sale by Apple's partners. They should do the right thing and do a point release of whatever iOS will run on the 3G containing just the security fixes.

If they never changed the benchmark to prevent the dead code removal (which is a valid optimization) in IE9 from kicking in, it's probably not a very good benchmark to compare Chrome with IE9.
