Which parts of GNOME are they using? Are they just using the component libraries, or the whole shebang? Are they using GTK+? (shudder). I want their source and window manager (think it'll look good at 1152x900)?
As you might know, I own my own domain name, and am slightly upset by this myself. One could say that one has the right to own one's own domain name because it's a trademark. However, this also leads to sticky situations - what if McDonald's Fruit Stand wants http://www.mcdonalds.com/? The way the auction goes is not that you start the auction imediately - you wait for the party to pay, and then start the auction. It's indeed fair for Mr. McDonald to register that name for his fruit stand, if he so chooses and McDonald's fails to pay. Trademark law takes care of Burger King registering that name (and also protects the Linux name, too). What the NSI is doing there is fair because it's the best alternative.

Think back to the boston tea party. We didn't want to be taxed, and we started a revolution! Revolt against the taxing republicans who also pander to big businesses. The best solution in this case is to have a system where each user has a Karma value, and users with low karma values are banned from searching/using the network. Moderators would assign Karma to users based upon comments in chat mode, downloads they've done, etc. Users with high Karma would get to execute their searches twice as fast (because they would get a priority flag). Autobots like this would be quickly moderated down and lose their right to search.

Actually, it's called a use tax. You'll see it when you're filling out your tax booklets in a sidebar.
