I think the court ruling could quite possibly affect search technology as we know it if they don't tread lightly. We already have methods in place (robots.txt) to prevent crawling from the major well-behaved search engines. If the courts do anything, they should require that all engines/spiders obey the site's robots.txt.
On metabrowsing in general-- I feel that a lot of these sites are out for the easy advertising revenue opportunity and have a "take it all and make it ours" type attitude. While these activities are good for the small guy, the industry leaders takes the shaft. However, usually the leader has the advantage of having more products, so the losses are somewhat less severe.
I think the core issue here is requiring that these meta-sites request permission of the companies they select. Or better yet, build a brand and a strategy, and make the companies want to participate. This does work: Pricewatch is a great example. And it's tough to even compete there if you aren't the best price, but companies participate because they know that being on Pricewatch is guaranteed exposure.
Needless to say, you can't go taking bottles of Heinz and Hunt's ketchup and repackage it as MetaKetchup. We need a degree of control, but obviously we want something that won't end up giving up our right to information.
What's the best (and only) way to make sure your teen (or kid) isn't looking at stuff online you wouldn't want him/her to be looking at? -- Don't have kids. In today's world many kids have external access to the web; off-home surfing. Their friends have it, their school has it, their public library has it. So much access to this. If any or all of these are using filtering there are always ways around it.
By this logic, we probably shouldn't have children because they could also quite possibly become psychotic serial killers. The more rational solution: Educate and/or supervise your kids. Be involved.

Secondly, any self-respecting company will want to protect their customers, so you can be assured encryption will be a given. Naturally, anyone dedicated enough can crack or hack anything, but to say that the method itself is unusable for 'Net applications is silly.
Honestly, I'd prefer the authentication to be in a separate device. I use a repackaged and modified Logitech Marble+ due to my physical limitations, and I'm not upgrading any time soon.;] And two buttons? I like three m'self.

Granted. They probably did pay a lot. There are plenty of firms that would've done it for less, but I'd imagine they wanted a firm with a strong reputation. RF can charge high dollar prices because they feel their real-world expertise in dealing with other high profile clients (RazorFish doesn't even try for anything but high-profile well-funded companies) is worth more than UnknownFirm. This makes them feel "safe" even if UnknownFirm could've done better work/lower price/etc.
2) DELIVERABLES. USWeb, according to reputation, bids high and gets the work done more or less within budget; RazorFish, and many others, tend to bid low to get the contract and then pile on additional costs as "unforseen" events arize. Usually this stuff is retainer work anyway...

Design firms that don't will soon find that an easy buck now could cost them future projects. Don't condemn the entire industry on your (limited?) experience.

The site is, really, pretty typical and average for what web design companies produce: nothing that 20 bright college kids couldn't do by looking at any firms' clients' pages and replicating... they asked for what a web design firm produces, they got what a web design firm produces. Caveat Emptor.

You're basically saying absolutely nothing aside from implying that "20 bright college kids" could design on the same level as RazorFish. I challenge you to prove this. And...Caveat Emptor? Always. OK, I know USWeb the best, and they run an incredibly tight shop that... well, works (slowly but surely) by strict adherance to formulas, guidelines and regulations. (Don't even mention perl if you want to be hired by them!). But billing at $300/hr and up for this crap? The work because Marketing is Big, CKS is a Real Ad Firm, and their clients Don't Know A Fuck about what is going on.
For such a strong subject and equally strong itemized list, you sure have nothing to say. Are you rehashing the price thing again? Big marketing always brings big prices. Honestly, companies that want huge returns understand that they don't come cheaply. It's fun to say they don't know what's going on though, isn't it?
I agree that there is certainly room for anyone (in any industry) to be paid too much for sub par work. Assuming the allegations are true, RazorFish won't get away without a tarnished reputation. There are other Fish in the sea. And they're even different colors and sizes. Maybe you should have a look for yourself before claiming to know "How Web Design Firms Work".
