    Then the consumer wins. Always remember, there is no such thing as some big corporation that is on *our* side. If Microsoft can make a decent product, we all win, that is assuming that they stop doing all that illegal stuff they were convicted of (which is a hell of an assumption)

    Can a mailman, or the U.S. Postal Service be held liable if I design my mailbox in such a way that stuffing an improperly designed envelope in the mailbox causes my house to burn down? Can the person who designed the envelope be held responsible? What if the envelope contained free samples of gun powder?

    It seems to me that the people responsible would be the mailbox designer and the idiot who purchased a mailbox that could potentially burn your house down (even if highly flammable object are placed in it).

    The question for the judge in the case if such a metaphor were used is did the envelope more closely resemble an improperly folded envelope, a free sample of gunpowder or a live grenade.

    the binary version of this software.

    Can someone please explain this to me? To me "machine readable copy of the source code" is another word for binary. If this is what they're trying to say, this is the most pathetic excuse to get out of the GPL that I've ever heard of. Does the GPL have a three year clause built in to it? And doesn't the source have to be included with the dist. not just made available?

    Either way, this is a win for GPL and open-source software, thanks to the software put out by Gnucleus (which still crashes my Win 2K box, as does the new Morpheus)

    If their legislation had passed, and if in the course of trying to DoS my gnutella connection they had downloaded my own copyrighted files, I would have had the right, NAY the OBLIGATION, to hack into thier servers, retrieve my files, and if I damaged anything along the way, I'm completely free of blame because of their legislation.

    And yet, something tells me that it wouldn't have worked out this way.
    Too bad.

    If gnutella is the service, and if the attack denies said service, then by definition, the RIAA is engaging in a DoS. What I want to know is what if the RIAA downloads a song from my computer for which *I* own the copyright? Can I sue them for copyright infringment? Or even better, if they're legislation had passed, and they downloaded my copyrighted material, would I have the right (nay the obligation) to hack into thier system retrieve my file and if I happen to fdisk their system, whoops!

    ISPs won't go along with Sony any more than Sony went along with the SDMI when they created mp3 players. ISP's know that people sign up for high speed internet in large part because of napster, and they're not about to lose that market just because Sony doesn't like it, just as Sony wasn't about to get cut out of the mp3 player business by a bunch of video card and modem makers just because Warner didn't like it. -Chuck
