    If i were to have some nice and illegal copywrighted works protected by a bizarre and ridiculously easy to bypass "access control" and the police confiscated it and read it, would they have violated the DMCA?

    IANAL... but.. well... since this has to be determined in a court.. we need to get into a court. That means a lawsuit. Who here has been denied a domian name or has lost their domain name for not paying? Or even paid for a registration? Or lost an arbitration to some corp through ICANN's system? Some of the money you pay goes to ICANN and ultimately the registrar got it's power from ICANN to distribute domain names. Sue the resgistar for charging a fee for a public service, or for taking your domain name away. Name ICANN in the lawsuit. and then it's appeal after appeal after appeal till you get to the supreme court. Is there another way to get a consitutional challenge in front of the supreme court?

    It's a brave new world. We work at internet speed. And the world changes every day. So our software changes with us. Even high quality products that are tested extensively eventually become outdated. I'm sure that Carnivore will need to be tweaked and updated on a regular basis to stay one step ahead (or behind!) of the more technicaly minded citizens and criminals. Once your team has finished it's review of the Carnivore system, what guarantees do we have that the next update to allow Carnivore to work with the "Next Big Thing" wont also include a hack to work around the privacy controls that allowed Carnviore to pass your review?

    Honestly folks... the people who work at MIT, Carnagie Mellon... the ones who rejected this project, are highly intelligent respectable folks. If they showed up on my doorstep I'd let them use my phone. And they all stood up and did the right thing.. they said NO. This is not a review you want but a rubber stamp. Did the DoJ take this as an invitation to alter the requirements? No, they just went right on down the list until they found the only people who COULDN'T say no... the people who work for them. And so the rubber stamp will stamp a seal of approval and the only thing left to do is bring Carnavore to the supreme court for violating the 4tm amendment. Call back in 5 years.
