I remember reading after the initial results that they were not sure, but just divulging their findings. Not making a clear cut case that neutrinos did, in fact, go faster than light. They took great pains to open their research and look for alternative answers.

Personally I hope Google countersues and gets 232 Million plus pay Google's legal bill as well.
