The ruling said that source code, being human readable was free-speech. Once you compile that code it becomes a tool to circumvent software, which IS illegal under the DMCA.
I am also in agreement. If your job security looks good I would try to find other ways to broach the subject to your manager, this of course depends on your relationship to him - in a casual atmosphere those kinds of discussions can be productive, threatening to quit if it doesnt change is generally counterproductive no matter where you are.
Until I was laid off I worked in a company which was slowly sinking, I watched several co-workers abandon ship for what they felt were better opportunities. Two of them have since been laid off at their new jobs. Bear in mind that finding a new position in this climate is not only about finding a job its about being able to keep it.
If you can come up with a list of positive changes which would require few resources, or optimizing current processes you may want to try broaching them in a more conversation rather than confrontational approach.
