    The SEC does not mandate a quiet period for IPOs. What the regulations require is that the company not make any effort to promote the company other than the offering itself. Also a company must keep track of all the material it used for promotion.

    In the world of the internet frenzy and the legal vultures, a lot of interesting theories have been offered, mostly because the SEC hasn't made regulation on these issues. Its generally the underwriter that enforces the "quiet period", in an effort to avoid any flaps with the SEC.

    Generally, the undewriter laywers will tell you that sites that have conversation boards generally can't use them to promote the offering. Does HQ know what it going on here? I wouldn't be suprised if they shut this thread down.

    Also, it's possible that the entire thread could end up in court one day in a shareholder lawsuit. Oh what fun.

    I'm also interested in seeing what happens with OpenIPO. Because of the dutch auctions, the IPO is not likely to see ANY first day gains, which may be pasted in the the media as a "linux failure", since they tend not to be familiar with the OpenIPO approach

    Will slashdot remain opensource? Will they start beating up anyone who makes a parody site? What about sites that have the same "trade-dress", due to use of the open source? Stock for people with high karma? Oh this is going to be fun.

    I use some source I ported over from NeXTSTEP called am. IT drives a Zyxel modem, and allows callers to either page me, or leave a message, or recieve a fax. When a fax or voice mail arrives the caller id number is sent to my pager via an email to pager gateway. I then forward the voice and fax mails to myself via email, so that I can get them and store them on my note book on the road.

    I'm also in the middle of using this technology to provide a replacement for an old VRU (Voice Response Unit) from IBM. It grabs data from an AS/400 and provides information to customers on current shipments etc.

    Very easy to write. My next project involved with this is to use ears, or something like it to convert the voice to text (and then send it to my pager)

    In life you need a bullshit detector for just these kinds of things. Stop and think of why it might be true or not true.
    1. It's April 1st.
    2. They won't name who the company is, on the basis of advice of their lawyer. I can't think of any reason why, unless you want to keep the other side happy.
    3. They claim to have voluntarily shut down their sites? Why? Why not just stop the individual act that is the basis of the legal claim? A voluntary shutdown means they can't countersue. It's also a part admition of guilt. It would be a bad legal move.
    4. Claim that motion has been filed. Motions are a matter of public record. There would be no point in secrecy after that.
    5. "Double-registered" What the heck is that?
    6. Contrary to TV, lawyers don't do a lot of face time. "my lawyers meeting with thier lawyers" And is that multiple laywers. For a free web site, they must be well funded.
    7. If it was "the evil empire", don't you think they would be protected
    8. His lawyers, "an IP firm", say they don't have a leg to stand on, but he takes this action?
    9. No attempt at media work, no real press, just playing on the netizens.
    10. They are all doing the SAME THING IN LOCKSTEP. When one giant goes after three little companies, not everything progresses at the same speed.
    Now what reasons exist for believing in this?
    Only that there have been a lot of stupid internet lawsuits in the last few months. But have any of them been anything like this?
