The diference is that the persons that use GPL code and wrap it in corba or COM havent payed for the code.
If i pay for a peace of music/film/ ect I expect to be able to do a range of things with it. (fair use) If the copyright holde dosent like that he shouldent have sold me the rights. /C
The fact is that you own your own body. I have this from my first (and only) semester of studying law.
I dont know if it applies fo the americans but it applies for England and most other european counties that have a common law structure with England.
The case that determes this is An old colonial case where a african chief in a English colony sued (and won) the englich crown because they burried his leg and could not give it to him. (the leg had to be amputated due to snakebite)
