interesting point; id like to note, however, that firstly, microsoft HAS done this (they stole the freebsd tcp/ip stack); secondly, in my ideal world, yes, microsoft could/would/should do that because their software (in my ideal world) would also be open source; thirdly, the GPL actually protects against such things in a world of intellectual property laws -- without taking advantage of those laws to quash freedom of source.

but its actually legal and though it may seem severe, its less.. controversial than many of the things done in other countries (carnivore, anyone?). dont get me wong, i oppose intellectual property laws almost across the board, but as far as following the laws that exist, this seems to be pretty much ok. note to self: stay the hell away from belgium.

  3. Re:Whats next on MS Wants To Outlaw Open Source: "Threatens" the "American Way" · · Score: 2

well, if you define the "American Way" as all-out laissez-faire capitalism, thn yes, Open Source does threaten the "American Way". The closest comparison to the Open Source Way in real life is a form of socialism (those who still think socialism == totalitarianism and/or fascism need not reply). Think about it -- all resources (code etc) are owned by no one person but by the community at large (aka the "state"); all in the community contribute to the improvement and development of the resources; the resources are free to access and use to anyone; the list goes on. admitted, there are areas where the analogy breaks down: coding for the open source community does not provide you with services other than the software etc; but still, the similarities are there. so, yes, it could be argued that Open Source is not the "American Way" -- but only if the American Way is supposed to be pure laissez-faire capitalism.

thats a good point, but it really doesnt apply in this case. this is not an engineered bacteria, this is a natural one found in the wild.. it already exists and already cleans up waste, we're just going to put it to use in places that need it. besides im positive that in ANY case such testing procedure as you described would be implmented.

one has to winder how this DMCA would affect modchips.. or are they illegal already? i dont know, i have one, i like my burned games ;) all backups of ones i bought, ofcourse *ahem*. according to an article on the ACLU website, DMCA "prohibits manufacturing or offering technology -- such as DeCSS -- that allows users to bypass measures that protect access to copyrighted works." -- wouldnt a modcip fit this category? and if so, how do they plan to get the thousands of distributors of modchips? should be an interesting battle.
