Ed, It doesn't have to be enforceable. If you have a webpage on one of the free webservers such as Xoom or Geocities, the lawyers will simply contact the service provider and state their policy. The service provider will then delete your site without contacting the you.
Of course, this isn't a problem if you are using your own server or your ISP is kind enough to contact you first.
