All they would need to do is document the failure with the associated problem level( i would make it critical). It would be up to the configuration control board to determine what to do with it. For criticals, the CCB would probably authorize an emergency patch/fix. The problem is this action would make Diebold look like they don't know what they are doing. Bad for marketing and keeping customers.
But getting your machines infected with know virii is bad for business also.
