This is comparable to an aircraft crash. Considering that nowadays speeds of 200 to 300 KM/H aren't uncommon, I bet some Al Quaida nut head is already studying the possibility of a terrorist attack on such a train.

There isn't any such thing as a supremely democratic and freedom-maximizing constitution, as the many rights we enjoy collide frequently. Therefore, your sentence "it makes me grateful that I live where I live, despite its many problems" applies to many countries, and to my understanding it means that you like the constitution you live with. That's great.

The point of a memo is to get some message across to everybody at aD. The mere use of the holocaust analogy overlays the engeneering issue with an unrelated emotional issue up to the point that no readers cares about what his sick and tortuous tried mind to get across. That's incredibly clumsy and proves that philg is a total management failure as he doesn't even masters the basics of human communication. I would've fired him on the spot.
I recall previous pieces of Redmond-FUD claiming Open Source Software to be un-American and relating the FSF with communism. This is pretty much the type of discourse Senator McCarthy et al made in the mid-50's in the US at the peek of the cold war witch hunt.
The ironical thing about all this, is that MS's attitude towards information (or shall I say disinformation ? ) and public relations is so similar to that of the Soviet Union: keep all things secret (the source) and keep churning out propaganda as a way of life. Is "shared source" some kind of Glasnost and will MS collapse just as the Soviet Union did ?
Another thing that strikes me is how un-efficient (if not even counter-productive !) MS has been with its FUD lately. I just can't find any report about their efforts on the mainstream web medias that is not critical. They have very little credibility.
MS FUD outbursts are really entertaining, you can feel the "Titanic hit iceberg" desperation comming thru.
But... what will we all rant and laugh about in 3/4 years time when it's all over ? What will Slashdot an The Reg do without them ? Hell, we need MS FUD ! It's time to initiate a think tank to stage a "Save the MS T-Rex" campaign". Is savemstrex.org still available ?

Getting VCs and Big Corp money and interest so deep into an OSS project doesn't boost it. On the contrary, the core motivations of the OSS developers get overlayed by typical corporate problems like turning a profit, defining a strategy, managing things and people, PR and marketing, and so on... OSS is more than just a license issue, it's about enthusiasm and faith, it's a community process where corporate interests are a nuissance. Why else does MS churn out Windows (because it's all wrong) while the OSS-community churns out Linux (because it's all right) ? Why else doesn't Mozilla succeed (too much Netscape in there) ? To all Gnome developers: kick the VCs out and ignore Sun and HP before it's too late.
There's a say here in Germany about SAP:
first they charge you with 1 mio. DM for the software, then they suck 10 mio. out of your pocket in implementation, customization, consulting and support.
By the way, there is no such thing as price transparency in the licence area - it's all very much a negociation thing where a whole set of complex "soft" and "hard" parameters are beeing considered (company size, prestige, competition,... )
