Companies are not people and have no such thing as human or civil rights and are not covered by the bill of rights. Individuals have the right to free speech, and their speech on behalf of a company is protected. But when a company puts forth advertising, that's clearly something different...it's non-protected speech because it's not an expression coming from a person, but rather, from a corporate entity.
If they can control when and where a company may advertise alcohol and cigarettes, they ought to be able to govern when and where a company may emit spam.
