We are a representative democracy. We are a democratic republic. People do vote (to elect leaders.) It would perhaps be more accurate to say: "Our republic practices representative democracy, with ballot petitions thrown in for flavoring." Democrat & Republican are orthoganal terms. Democracy and Republic are not mutually exclusive.
Perhaps I am naive. I was under the impression that the DOD (like the DOT, IRS, etc...) was and always(?) has been a part of the executive branch. No "emergency" is necessary for the president to be the commander-in-chief. Yes?
The question of who will watch the watchers is ancient. I think congressional control of cashflow is limited by an agency's control of info flow.

Is it against our law to intercept another countries transmissions? Do we have a treaty that specifies against such behavior? It might be unsavory but methinks its not *illegal*.

Be it C, assembly, or binary (though few talk binary these days).

Hence I haven't broached anything. So this can't be about adding an extra offense to copyright violation because it doesn't apply to the act of copying the copyrighted material.

The point is for works to promote the arts and sciences, chiefly by there being very many works which are in the public domain and are totally free for anyone to copy and use at will. In order to achieve this, Congress may permit authors and inventors short-lived and limited monopolies on their works and inventions.
Methinks its about a ballance: promoting (maximizing) the public good while doing the least necessary for the artist to allow the artist to continue generating. The original intention was that copyrights would be short term. If you wanted to be cutting edge you bought it new. Else you'd wait for the expiration of said copyright and get it for *free*.
