This is a criminal case with the State of Georgia. Looking over these, I think he's in trouble. There is some truly scary language, like "victim expenditure" and "Such crime occurs at great cost to the public, since losses
for each incident of computer crime tend to be far greater than
the losses associated with each incident of other white collar
crime;". It appears that legally the prosecution can ask for not only penalties, but also restitution for all of the cleanup expenses on the computers. It's also interesting to note that they are asking for the maximum penalty.
