To control how programmers write their code - that's how the government has chosen to address this particular problem. Infringing upon the civil liberties of programmers rather than finding an actual solution. It's dangerous perspective - that creates a climate where the Internet is seen as evil, and scary, and the only way to tame it would be to create more and more restrictions.
By no means am I an anarchist, but nor am I a capitalist. To rail against the constrictive efforts of the government is just, because they opt to take the easy solution rather than an equitable one.
