All this discussion of appropriate royalties (and a 5% of 0 [sales cost] being free) ignores the fact that you first NEED to negotiate with patent holder to obtain a license.
Price isn't the only license term that is at issue.
Patents are not compatible with standards.
Royalty-free may be the lesser of the evils, not it HAS to be RFND (Royalty-free AND Non-Discriminatory)
