If the messages are classified as spam, and it's a matter of spam and not of free speech, as the company states, I can't understand why the company is wasting money to defend the rights of other people (the ones that receive the spam!). May I call them when I receive spam so that they do the lawjob for me?

Employers are not against spam, they are just against any damage to their corporate image.
