This kind of thing (assuming it ends up used on crowds) often ends in the form of a lawsuit. Firing one of these things on a large crowd of people will eventually find the exception to the "non-lethal" rule, a wrongful death lawsuit will be filed, won, and the device banned from such uses.
If it was up to me, I'd be the most intelligent person in the universe and everyone else would fall shy of my marker. I mean, there is a HUGE correlation between my thinking people are stupid and my thinking people are stupid.
And, there would be a tax... a dumb tax. The smartest people would be subsidized through taxation. i.e. Depending on just how much less intelligent you are than me, you'd have to pony up a certain coin.
The scale would range from almost as smart as me to dead. You would receive income based on your placement in that scale. The lower on the scale, the more physical labor you'd have to do earn a living. Can't have stupid people exercising their brains now. Could throw off the whole Thing. Of course, I'm really the most qualified to determine who does what. I mean, I AM the smartest.
Everyone would submit payment to me. That's really the only smart way to do this. I would then dole out the appropriate funds to deserving brains that amused me.
This would allow smart people... me... to keep on doing the brilliant things I do. Like posting here. Damn I'm smart. Damn you're stupid.
I believe iTunes and the iPod product family can play formats other than Apple's AAC. If not, ignore rest of post.
If Real was really interested in giving their customer's a choice, they'd deliver their music in a variety of common formats. Customer's could then download the format that worked best on their individual system.

yesterday it cost X amount of dollars to see a movie. Today it costs 2X dollars to see a movie. yesterday a movie was released in major cities at major theatres. today a movie is released in as many theatres as possible (they even note it in press releases).
yesterday track runners wore basic tennis shoes, shorts, maybe a t-shirt. today track runners wear highly advanced running shoes, a tight fitting, aerodynamic body suit and concentrate the better part of their young lives training.
Is it any wonder that the scores are getting better? Is it really a surpise that world records keeps being broken. Is it really that profound that the movie industry is making more money.
To adopt a robin hood attitude because it suits your needs discredits you. That myth is based on a man who wasn't nearly as altruistic as we'd like to believe. Neither are the motives of those who pirate movies and music. "I did it for my country, for my people, for....FREEEEEEDOM (guts being wrenched out by the queen's executioner).
