    Actually, I think the first poster may have been correct. A track record is a record of things that have happened in the past. So if we're talking about a list that extends from the distant past to the present, when it terminates, then I'd say the present tense is justified. If the poster meant to say that until this point the track record was better, then "had" is the right choice. But if he/she meant that even given this incident the record of Cisco is still better, and I think that's what he/she meant, then "has" is more gramatically accurate.. I can't believe discussing tenses on Slashdot..

    I think laws like this shouldn't be too much of a restriction. There is no lack of talent in Canada. Local artists in Kitchener/Waterloo alone could fill up the regular play lists, if their discs were actually played! The trouble is that most people only want to listen to the mindless stuff they're used to hearing on the radio, and not listen to the wealth of talent that exists in a diverse range of other styles. I think that was, in part, the spirit of that regulation, to encourage a more diverse playlist. Unfortunately, it just means we hear more of the same mindless stuff more often instead of being exposed to some really innovative new artists. Blame the stations, not the regulations. And I suppose ultimately, we have to blame ourselves - if we REALLY wanted to expand our horizons, we would do it.. Most people just never want to take the effort to do so.

    I agree with you 100%! Unfortunately, many people never bother to check out their EULAs, or even know they exist. So while commercial software is no more accountable than OSS in actual fact, this matters very little when the perception is otherwise. So you're both kind of right in a way really. =)
