    You are clearly misinterpreting the article. This "gray" information does not belong to the US government. As stated in the article, it consists of things like dissertations that are likely only available in university libraries. If you have access to a good library and the time to do so, you can probably arrange to look at all of that material you want through inter-library loans, but it is unlikely to be available online before the copyrights expire, if then. As for the use of the term "open source" in the article, it has been in common use within the intelligence community for many years (certainly since 1987 when I was working in the intelligence community and probably long before that), long before anyone considered applying it to software.
