This is being confirmed by the court: 'It can be assumed that Kazaa would not have to sell if Kazaa had it in its power to persue another way of meeting the president's request' In other words; BUMA (dutch riaa) has executed an invalid sentence, according to Alberdingk Thijm. In theory this means that Buma can be held accountable for the sale with a lower value then would be met otherwise.
It is not yet clear wether legal steps will be made against the BUMA. --
Now this does raise some interesting questions. Apparantly, with enough legal backing and loopholes, setting up kazaa-like services can work as a good business-model.
